last night sucked

went out with some old friends last night and broke some things that I didn't need to break on the truck and when I got home at 1 this morning after a long night of racing. (still had the slick on the truck)

I arrive to the cops and my ex wife. My brother and his girlfriend was there and my mom had my daughter. They claim they were fixing to call me and see where I was cause I supposedly beat the mess out of her.

Hey Goat....I had a similar problem with my kids mother about 12yrs ago when i was a Sheriff's Officer. She was trying to get me to loose my job and locked up But i had proof i was'nt near her. What u need to do is document what happened with a police report okay.....And get your lawyer and file a false accusations charge and a lying under othe charge against her....Then with that you get a restraining order, or she is going to keep doing things like that until something sticks and you find yourself in jail waiting for a bail to be set.......be careful!!!!!! All phone conversations must be RECORDED!!! So she can't claim you threatened her in any form......Good Luck dude...

Recording fone calls has a specific set of "rules". 1 is the party being recorded, has to be made aware it's being done.
This biatch may not be so dumb as to have a conversation AFTER she is made aware of the recording.....

Maybe, just move out to the center of your 4000 acres, and forget her??

Only one of the people in the phone conversation has to know it's being recorded. You just can't have both parties not knowing (government wiretaps for example).

Check the state laws where you are and where she is. Different states have different rules. Here in VA, only one party has to know they're being recorded.....ask my ex !!!!!!

Thanks guys for chimming on my side :biggrin: I'm not trying to have a pissing match with you Chuck, but i'm a ex Sheriff's Officer and i know plenty of Judges,Prosecutors, and Attorneys. Being that i live in one of the toughest law states in the US.....New Jersey...Where you can get a gun permit for hunting and target practice, but NO PERMITS TO CARRY UNLESS YOU ARE LAW ENFORCEMENT OR ARMED SECURITY....with Very Litttle exceptions....Even here you can RECORD ALL CONVERSATIONS....expecially in Goat's situation where he has to PROTECT himself from FALSE ACCUSATIONS like his ex tried to pull on him, because domestic violence in my state is a VERY SERIOUS thing. A person with that charge in NJ could easily be given a 50,000 or more Bail

Roughly half the states are "1 party" states, and half are "2 party" states where both people in a conversation have to agree to the recording. Like Dabiguy said, VA is a 1 party state while MD where I live is a 2 party state. Remember Linda Tripp from the Monica Lewinsky debacle? As I recall she was about the only person in that mess to actually be convicted of a crime, and in her case it was because she was in MD when she recorded those phone conversations without notifying Monica. Like most legal questions the absolute best answer is to check with a local attorney .
