oh i forgot to mention something...this may be important or not...but about a year ago i, along with 10 other people got busted drinking at a party...i wasn't 21...i got charged with minor consumption and had to pay a $150 fine and i guess i have a record...

so the cop knows about this...is he trying to base the fact that i am "capable" of this crime just because i have done something wrong before??? even as minor as that? you can't base a previous crime on something can you? maybe that is why the cop is harrassing me...

How about asking all these questions of your lawyer? IMO, you stand a much better chance of a correct answer, than asking them of a bunch of $hithouse lawyers on TB.com!! [Like the radius kid!!! Last I heard he had given up his law practice to become a machinist]:rolleyes: :rolleyes: :D :D :p

Don't worry about it. If they suspected you they would have been speaking to you. They prolly know somebody else did it.. Try and Relax..;)

Relax..

..and don't say a thing. Let your lawyer talk for you. After you are cleared of any wrong doing, I would be sueing for harassment(sp) and claim you could not sleep along anything else you can think up..;) :eek:
 
Don't even waste money on a lawyer just say, "I have nothing to say other than I am innocent." It will go away unless they come up with evidence which they won't if you are innocent.

"Reasonable Basis" is pretty vague...the accusation of the other guy would be considered "reasonable basis". If a cop asks if he can search your trunk, and you say no, THAT'S "reasonable basis".

BUT, I know this much--if that guy had accused you of 'touching' a sister or daughter rather than his car, you'd be in jail right now trying to find the $25,000 bail to get out!

However, the chance of actually getting arrested based on a heresay accusation of a civil crime is pretty near zero, so I wouldn't worry about it. Just beware that it CAN happen!

Sorry to hear about your situation.

I'd prolly call the policeman (who is just doing his job) and leave a message something to the affect that you have no knowledge or involvement in the incident he's investigating. then say something like "If you have any questions, please direct them to my lawyer. His name is....At this address.... And this phone number."

When you avoid the investigator, it does not put a favorable light on you, your girlfriend, or your actions.

I'm ready to buy that laptop anytime you decide :)

Personally I would ask him if there is a specific time and date that this occured on so you can give him an alibi, if he can't give you anything specific then tell him you aren't able to help him untill he does more investigating about the crime itself and wheather it is insurance fraud. If he actually can tell you what night it occured on, then give him your alibi. I am guessing you don't work 7 days a week so telling him you were at work during that time will lead to it happening on your day off, and then your alibi won't hold up.

And yes, he is on a fishing exhibition so just ignore the bait and don't tell him anything he doesn't need to know.

Your first point is a moot point,however I would think that it would have to have some basis in fact other than "we don't like each other".
The second point involves direct evidence of an involved party[ie.,I was assaulted by so and so].
I think your last point about sums it up.
Any cop stupid enough to arrest someone on that kind of accusation must think his department is rich$.
People tend to think the police are gods.They're not,they have to enforce the laws properly.
If they don't,they know the public has avenues for retribution open to them too.:)

Assuming Don had nothing to do with the incident....The assertion by the former boyfriend sounds like "conjecture" to me (Inference or judgment based on inconclusive or incomplete evidence; guesswork.)

I certainly hope that conjecture is not enough to get you arrested. We have enough conjecture inpolitics, we certainly do not need it in police work ;)
 
1st. exercise your right to remain silent, then clam up and ask for a lawyer and make them pay. they dont have witnesses and hopefully you can attest to where you were when that happened but even if you cant, they still have no case against you.:cool:
 
Hey, like I've mentioned, l ain't no lawyer! Heresay is "second-hand", Conjecture is first-hand... okay, got it :)

All I know for sure, is what I've personally LIVED thru, like the Medellin Cartel being busted in my spare bedroom :rolleyes: And that ain't ALL the legal crap I've lived thru, by a longshot...;) --that said, I don't want to confuse any issues, so I'm done now!
