Can/Will a fmic be a reason to fail a smog test? I live in Ca.

Depends on the tester. They might fail you for visual, although I made it through all the time I was in San Diego.
 
I would say that if it is just the IC piping and intercooler that is not stock, then it should pass. I had my smog license for 4 years and passed many cars with aftermarket intercoolers. The intercooler is not actually an emission related part, and there is a section in the smog "rule" book that states that aftermarket intercoolers are items of no concers. I believe it may be appendix J or K. But a smog tech that is willing to work WITH you instead of AGAINST should be able to figure that out. It is seriously RIGHT IN the smog book - Along with aftermarket intakes withouth CARB #'s. As long as the evap lines and PCV lines are still routed properly.
