Saturday morning I was on my way to pick up some money from the ATM machine and then heading to the track, when some wack off decided to make an immediate left turn from the far right hand lane, and guess who was going straight in the center lane?.....me.

Well, I slammed on the brakes and vered to the left and just couldn't stop. I ended up making contact with the Nissan pickup and tearing up my right front clip, right fender, and right rear quarter panel, and some scrapes through out the right side. There is no frame damage, thank god and everything mechanical was un-touched. Anyway, I drove the car back home and parked it and then notified my insurance company.

One thing was good, the police showed up within 2-3 minutes and did a report. Afterwards , the police informed me that the party at fault may or may not have insurance....They people said they did, but after the officers looked at the insurance card, it didn't match the vehicle they were driving. These people were cited on the spot and hopefully Monday everything will be sorted out, I hope they do have insurance.

Good news is, if they don't have insurance... I do have uninsured motorist coverage and hopefully it will cover all the damage and then some...Well see what happens in the next week or two:rolleyes:

Sorry to hear about your accident. Hrmm? No insurance? What kind of Nissan pickup? :D If it's halfway decent, hand over the pink slip and call it even. :)

Uninsured motorist coverage doesn't normally cover damage to the car as far as I know. My understanding was it is for bodily injury. I could be wrong though.
 
The insurance rep. said I'm covered up to $3500.00 if the other party did not have insurance. And afterwards they will be taking the person at fault to court for reimbursment for what ever amount it cost to do the repairs.

I hope this is the case, I'll know a little bit more later on today. Hopefully it will be positive :) If not, I guess I will have to take them to small claims court;)

85GN - Thanks bud and as for the Nissan P-UP, I'm almost sure it will be scrap. The door couldn't close and I could tell It had some bad structual damage to it up front . But you never know....:rolleyes: The guy driving or even the lady with him couldn't even speak english....One could tell the police were getting flustered with them....:eek:

Once again, sorry to hear. Sounds like you're taking it well. I always thought I'd go ballistic when someones stupidity wrecked my GN, but it didn't happen like that. Just brushed it off and waited for the insurance to dance around.

I've worked at 3 diffrent US Embassies around the world, Zagreb Croatia, San Salvador El Salvador and Manama Bahrain and it was mandatory to learn the language of that country to the best of my ability just because I was a resident. This was also a State Department protocol for security and safety reasons.

Otherwise more than anything, it's a common courtesy to learn their coustoms and way of life in general.

People of the country your a resident in tend to appreciate you a lot more and you make a hell of a lot more friends in general just knowing you are making an effort in trying to learn their way of life, instead of taking it for granted.

If you are a resident of the U.S, you need to speak the language, simple as that. It is a common courtesy and shows respect for the country your residing.

Otherwise, I do try to remain calm and collective at all times and asses the situation I'm in. I'm not sure if these folks were even here legally, that remains to be seen. The police officers even said it's very normal and that they see it everyday illegals driving without insurance and what have you....

Anyway, I just want my car fixed right now and taking care of that is my sole intentions right now. And i'm sure if they are illegals, they will be delt with accordingly.

your car can be repaired under your collision coverage (less your deductible) for whatever it costs....I would be a little nervous about that "up to $3500" thing, 'cause that means they will prolly total it if damage is in excess of that number

your insurance co. can then sue the other party and try and recover their costs and your deductible

(unisured coverage is for bodily injury only - no physical damage)

I would also be reasonably nervous over that $ 3500 Maximum disclaimer statement. I saw a statement a while back in an auto repair shop that advised that you have a right to have whatever body shop that you want to do the work. Also, doesn't Kelly Blue Bood list the GN'S somewhat higher than that? I would be looking into that. They just wanted to find out what your reaction th the disclaimer statement was. I would go get all high dollar estimates just in case. Let the Insurance Company appraise the damage after you have your estimates. Don't settle for any less.

Thanks for the info as I learn something new everyday:) Well went to try and get a copy of the police report only to find out it will take up to 10 working day's to receive it. CA is so jacked up with everything as I know the insurance company needs this report ASAP to process the claim. Nothing but a run around it seems...... :p

I understand what you guys are saying, I'm already putting a list together of what most of the parts are and what they cost. I don't forsee it being any more than $2000 -$2500 to repair everything. I can do most of it my self except for the dent pulling on the rear rt quarter panel, which isn't really that bad. I guess I just want to make sure it's done right.

Uninsured coverage in Texas covers damage to the vehicle and they will pay whatever it takes to fix my vehicle. Been there done that with a scumbag pulling out in front of me. The only catch is the insurance will try to asess a percentage of blame and then deduct that percentage from your claim settlement. Mine was 0 percent in my favor, 100 percent the dirtbags fault.

It happend on Oceanside Blvd by the 7-11 just as I turned left of of Coast Hwy. Your right though, the people do drive like idiots around here. Reminds me of NY:D Well, maybe not that bad;)

Thanks for the info, I sure hope this applies here as well. I do have a witness that seen the accident and he came forward on his own behalf and wrote a statement and what have you. Also I know I wasn't at fault, so I hope the odd's are in my favor too.
 
Uninsured Motorist offers coverages for bodily injury and/or property damage. That 'up to $3500' thing sounds fishy to me because you determine the limit in the policy just like any other coverage and $3500 does not sound like a ligitimate amount. For instance, the legal minimum amount of LIABILITY that a person can carry in the state of New Mexico is 25/50/10--therefor, the amounts of Uninsured Motorist coverage available start at similar levels.....so, $3500 does not compute. Although, with TORT states and whatnot, alot of black and whites have been greyed. Also, I'm sure that California's minimal coverage requirements are higher than here due to how anal that state seems to be about everything. As long as you're covered, don't spend much time worrying about the ins. co. having to take these folks to court because they will pay you and then assume the responsibility to subrogate from there on.

All of these things vary somewhat from one state and company to another, as you know, but the basics apply (more or less) universally. The most important thing to remember is that the ins. co. is accustomed to dealing with alot of folks who only own one car and if it gets wrecked they are in a serious hurry to have a ride to work again.....that being said, they're used to dealing, for a large part, with people who have little choice but to buckle and accept what they are offered. You not being in that position, do not bend...keep fighting them 'till the bloody end and get what you are owed. Alot of insurance folks would do well to look up the word 'Indemnity' in the dictionary once a day so as not to forget what their job is. Keep us posted. Hopefully you'll have a good experience....it happens occasionally. ;)
