When I first read the title of this thread I thought the parents were actually being charged.. this looks like something far less. The article said that they could be given 2 years and up to $10,000 fine... I don't think it'll go ALL the way up to that. I think that's just the max.
Plain and simple fact... 90+mph + head on collision = very little that bad brakes or worn tires can help. I think the state is trying to catch all the dragons it can with this net. They may get a good slap on the wrist, but I don't think it'll be considered that it was the sole contributing factor.
Didn't really give too many details of why she swerved either.
