Branded title in California

I am looking at a Turbo Trans Am in California, that according to both Carfax and Autocheck, has a branded title odometer rollback. The owner of the car swears that the title is not branded, and that the car has never been in any kind of accident, and that the mileage is correct. He says that he thinks the reason why it shows branded, is because one time the car did not pass emmissions, and the guy at the station wrote the wrong mileage down, and when the owner of the car brought it back later it passed, but now with different miles on it. He is going to fax me a clear title, and I am going to take it to DMV to get it checked out. Anyone from Cali that knows anything about passing smog, and any way it can cause a branded title? thanks!!
 
Carfax for my wifes GN showed the same thing. It was very obvious it was wrong mileage noted at smog check. We owned the car at the time so I know it is bs.

But I don't care, it's not for sale.
 
I have a copy of the title, and it is clear. However, I am worried after I change the title into my name it will come back as branded. Does anyone know any way around this?
 
Same thing happened to me at E Check. The idiot wrote done the wrong mileage and Car Fax says becareful of odometer rolback. But if you close at the car fax it looks as though I turned the miles AHEAD. It shows at E Check 29000 miles and later the SAME day it has 49000 miles. Idiots!! E Check,and Car fax would do NOTHING to straighten it out.
 
carfax is a fraud!

I have had 2 cars that carfax reported as clean titles and were infact branded.
I took carfax up on there buyback guaranty, they denied it, I eventually sued them, and got more than the car was worth, and kept the car!
there are many lawsuits against carfax, I can't see how they stay in business.
go to this site and run the VIN# using vin check.
