Buying a car with out title

I am buying a car on ebay again. I have the cash to pay for the car and talked with seller. He does not have a clear title. Bank has title. I can only drive down to pickup the car on weekends but his bank is only open on weekdays. So I cannot give him the cash to get the title at the same time. He suggested that I drive down and get the car and give him the cash and he will mail me the title the following week.

What would you do?

Try to find another way is what I would do,but if it has to be then write the check to his bank with the memo saying pay-off and give the balance check to him when you get the title,face to face...My close friend just did it for a guy he didnt know,actually my buddy was the one that had to send the title when he got it from the bank...but on ebay,im not sure if I would do it..

Take a vacation day. Who's to say he'll payoff the bank and get the title released? I bought my GN in a similar situation and I sweated getting the title for a month. Finally had to get a friend of his to get me a duplicate and mail it to me direct. Cash in hand - title in hand- done.

I would not buy a car under those conditions. Either take time off of work, pay a friend to make the trip for you, or something, but I would not do what you are going to do the way that you described it. It's starting to sound as if you and a friend had better make the trip, you with the cash, and the friend riding shotgun, with a shotgun. Just kidding, but you need a better foolproof plan. And that does not include a plan designed by the seller.

Thanks for the responses. I know what a weird bank, but an employee there at the bank offered to meet with us after hours on Saturday evening to make the trade. So tomorrow afternoon I shall have another car, this one is going to be my sons first car unless I like more than my 98 GS daily driver.

simple solution

Make the check out with his name and the banks name on it. That way he has to sign it over to the bank. If the selling price is more than the pay off. Send him the balance when you get the title. That will give him incentive to get moving.
