They can be replaced; apple runs an exchange program for $99. Send yours in, get one back with a fresh battery. It won't be yours though, it'll be someone elses (whatever they have on the shelf at the time.)

There are also some DIY 3rd party options for ~$50.

Based on their "average" use, Apple says you may start experiencing battery problems (not holding a charge) as early as 12 months.

It's better, but I doubt fixed. The lithium polymer batteries they use are a newer technology and not completely done being developed as far as I know. If you're going to buy an Ipod (and they are nice) I'd suggest getting it somewhere you can get a service plan that will cover the battery (I'd suggest Best Buy, but I'm decidedly partial).
