heres the thing...my brother was driving thru his college campus today and a tree fell on his car. not too much damage, just the trunk lip and the rear window need replacing. now granted it was a windy day, is the college responsible for what happened?

Only if they were somehow negligent. Was this a dead limb that came off the tree and if so should the school have known about this and trimmed the dead branch off. Were they negligent in the upkeep and maintenance of the tree? If so, he might have a case. If this was a healthy tree and properly maintained and a storm is solely responsible for the limb coming off, it's an act of god you have no cause of action against the property owner.

Hmmm, is it still an "act of God" if you are an atheist? Just wondering.:D

Good one....lol.

And if you're an agnostic it would be an act of maybe, maybe not.:)
