Question about workers comp benefits

So I had carpal tunnel release surgery done on both of my wrists. ( I didnt think I was getting that old, im only 35) Just had the latest surgery 2 weeks ago. Everything appears to be going just fine. A little sore but otherwise no more tingling hands! Im back to work full time with no restrictions.

My employers workers comp insurance carrier paid me for the time I missed work. 2 weeks for each wrist. Timely payments too.

My question is, would I be entitled to a workers comp settlement from the result of these injuries? Ive been doing the same job for 18 years with the same company.

Im not looking to create problems at work. Just wondering what my rights would be.

That falls under the WC laws as well. You would have to check your states WC laws to see if you can file for recourse but you have to have a permanent injury most likely to have any case at all. If you can go back and do the same job you are considered fixed. Good luck.

You're lucky you don't have a self-insured employer who will refuse workers comp for carpel tunnel all the way through the appeals process just to be Aholes! They know they're gonna lose but they always try crap in the case of any injury, like asking if you ever played sports in high school or some other 'seemingly' unrelated line of questions to attempt dodging responsibility for anything that doesn't bleed.

Consider yourself lucky that you got it fixed without a headache!

I am very satisfied with the outcome so far and that it was covered! Just hope I don't start getting bills in the mail

If you've got a WC claim#, you've got no worries!

From my friends who've had the surgery, don't rush them hands. It's like anything else, just cuz it don't hurt doesn't mean it won't persistently if you don't excersize caution. That Buick will wait for you!

Anything workers comp gives you, take, that's why its there, it has nothing to do with your employer, I had a .030 drill break in my finger at my old machine shop, went to a walk in got it removed, and the second xray showed the very tip of drill and a few small fragments still lodged in the joint... Well a more involved surgery was needed by a specialist, needless to say workers comp took care of everything I even got a $750 check for a 1" scar on my finger...Mike

Well my wife had rotator cuff surgery. She wasn't a professional baseball player so they only did what they had to. This too was a workers comp claim. It has never healed right and two doctors have told her it's as good as it will get. Of course this created restrictions as far as her job so the company laid her off. . . . . . . . . . . . . . . . . . . . . . .Permanently. She is now unable to get another job and workers comp made her an outrageous offer to settle and we turned it down. I already had a lawyer on retainer. We are now suing the company and the insurance company who represents workers comp. Just letting you know that workers comp is not the last stop. They are just another bureaucracy.

In Texas, you can only sue if there is gross negligence on the part of your employer.

You are entitled to lost wages & medical. You can also get extra money if the doc assigns an impairment rating for the injury.

Texas reformed the WC laws back in the 90's to prevent lawsuits anytime a worker bent over and claimed a back injury, real or not.
