Hard to deny that. Had they built the roads correctly in the 1st place.....
So did you arrest him?
My ticket for 106 MPH on a five lane interstate was only matched by the reckless ticket they gave me as well. The problem, it wasnt me, really, it wasnt. I was exiting the freeway and didnt go above 65 MPH for that entire stretch of road.
I would think, again if your laws are like here, that he would have been arrested for careless driving. If that would have been here I bet they would have tried to pin attempted vehicular manslaughter on him.

Here Careless Driving is still a Civil Infraction (3 points) and not criminal which means it's non-arrestable. The next step up is Reckless Driving which is arrestable (6 point misdemeanor) but is a pretty high standard to meet. The law states you must demonstrate a "willful and wanton disregard for the safety of others". I didn't think the high speed alone in a BMW rose to that level. However, if he were abruptly changing lanes or passing on the shoulder then I would have. 49mph over the speed limit in a construcion zone is 5 points and probably close to $500 fine anyway.
