I was just told about this check point in my city. Are these check points even legal, mandatory or are they voluntary? I've heard that you do not have to do the onsite smog test and it is voluntary but not exactly sure. Anyone driven through one?

The AQMD sets up road checks whenever it pleases in high smog areas usually to monitor the success of the smog program. It's legal & enforceable & hope you don't get caught in one unless your car is smog legal.
 
Thanks for the response and the heads up Lou. I sure hope they keep them check points on the opposite/rougher side of town. ;)
 
Saw one here a few years ago. Signs said voluntary survey. I believe "Am I being detained" and "Can I go now" are the proper responses.
 
Saw one set up in San Jose a couple of months ago. Not sure if they were pulling over cars at random but I heard they have a sensor that you drive and it flags you if numbers are high. I have no idea whether that's true or not, maybe someone can confirm?

I saw one in Whittier and pretty much its like d.u.i check point so u better be ready if u get caught.

Seen them videos on YouTube some have been successful some were not. Around here, anyone with a badge likes to abuse their power and then they charge you with as many bogus charges as possible.
 
I have seen 5+ in the L.A. area and believe me, they are not voluntary. There is always a CHP cruiser attached to them and they close off all lanes except for one so they can catch their victim. The test they run is the exact same one you would have to do at any licensed smog station. You don't want to get caught in one without a cat or CARB authorized modifications to your car. I hear those fines can really add up....
 
Anyone know how much the fines are and if its against the law to look at your vehicle with out a search warrant or your consent?

In your case they would probably make you put the original engine back in with all the smog equipment and make you go to a "referee center" for inspection.. Unless when you put the turbo engine in the cutlass you took it to the referee and had it certified by the state? I don't know about fine amounts but I would avoid a smog checkpoint in our cars at all costs. I posted the actual law above and its been in effect since the late 70's...

That 307 is long gone. Wonder after a check point if I'm able to go back to a stock 3.8 turbo smog legal setup to be able to pass an emissions test and then get it certified by the referee? I was told that as long as the cars donor engine is smog legal, same year as the vehicle or newer then it would be possible to get certified by a ref, but do not know how they would react to a modified transplant before the any certification.

I love California but damn these dumb laws!

Hope I never get in one of those traps!
 
I have heard that they can only pull you over if no more than 2 cars are already waiting in line.
Not sure if true or not.
 
Al you need to run for governor of Ca.....we need a real bright guy like you to get California back on track!


Well thanks Gil but i dont think California well be back on track ever again no matter what bright guy runs it.
