Depends on the station. I've had fly by night stations (when I was living there) fail my K&N.
And other times, I could pass a test only station (maybe because my filter was hidden down behind the headlight/bumper).

You will fail almost every time however, if you have K&N style breathers on your valve covers.

If they are failing you because of the K&N filter, you can get a special sticker from K&N which will make it smog legal, my friend just put a sticker on his turbo supra, and it's now a legal filter.
