I got into an accident Sunday. Some little honda ricer was showing off for his buddy and drifting on this dirt road where the speed limit is 25 and the road is close to 50' wide and he came around the corner with the rear tires locked up and slammed into me at around 45mph. I was only about 5' from the burm on my side and he knocked me into the dirt burm on my side. Now I have a damaged disc in my lower back and his insurance says "we don't cover lost wages" since I can't go to work until this is healed up. I figure I need to get a lawyer to make them pay for my lost wages, medical reimbursment, MRI AND fixing the vehicle. The pain pills take away all the pain and I can walk now but I just can't stay home and do nothing. I need to be busy.

Anyone else have problems with the other guy's insurance and had to get a lawyer?
 
When Suzanne got hit by a drunk she had similar injuries, and got similar answers as you. Definitely get an attorney and let them deal with it, it paid off in her case. Might not be a bad idea to at least threaten to sue the little punk that hit you personally also.
 
If you're really injured - get a lawyer - you may have won the medical lotto. :wink:
 
Thanks guys. I am going to call his insurance tomorrow since they came to inspect my vehicle today and now I get to wait and see if they want to "total" my S10 or just fix it since I didn't ask to be hit.
 
I pray that I am not really hurt. I love what I do and cannot be the one to sit around. If his insurance messes around I will get a lawyer. If they do right by my vehicle, then I am going to demand they pay my lost wages and then really get a lawyer and put it to them.
 
Get a lawyer and don't do anything that shows you may not be injured. Go to the Dr and any specialists and make sure to get a police report. You got some money coming your way.

Don't worry about dealing with the Ricers insurance company about your S-10.

Your laywers advice is what you need before dealing with them.

My insurance is right there and they are sending out an adjuster to inspect also. They have advised me to get the medical help first and so far I have only had to put out $30 for all the tests and Xrays I did yesterday. They are looking to collect for me and I just want to make sure that his insurance pays for my lost wages and since I won't be able to work as fast as I normally would, they need to compensate me for that loss too. I just have to wait for the MRI on next Tuesday to see how bad things are with my disc and pray I won't be hurt for life. The pills they gave me let me walk good and around 98% pain free with them but I have to take it easy for a while. I just hate sitting around. I got a release to go back to work but not going to get much done without being able to do my regular duties. Thank you very much for your advice so far. I am taking it all in since I have never had to deal with this kind of situation before. I appreciate it a LOT!! :)
 
His insurance will be paying and if you want you can drag them through the mud. The other driver was driving like a f uck bag and injured you. If you get an attorney you will have a higher possibility of getting more $. If you are truly injured and it will effect your quality of life in the future ten you should get as much $ as you possibly can. Dont let them tell you what they are going to pay. You own their ass and make the calls as to whether you feel you are being compensated fairly. If your not then you can drag them out more and make them pay more. The last thing they want to do is be dragged into litigation when they know they are going to have to pay. They will more than likely try to settle out of court with an initial low ball offer. So if you feel you are being dicked just refuse the offer. Your lost wages and pain and suffering all have to be considered in the offer they are giving you.
 
Back pain=pain and suffering for life, get what you're due.
 
Back pain is for real. Monday it took me a full half hour to get out of bed. Felt like my back was being ripped open with a knife from my belt line to my kidneys on my left side. I took 6 Ibuprofen and could barely walk when I got into work and just did a little and went to Dr. I am scared to death that I might need surgery but also know people who have had injury and then surgery and they are worse off now than before. This means I would have to sell my Vega as I would not be able to work on it anymore. No more doing what I love. I build trannies here at home and would never be able to move heavy objects again. Quality of life would be WAY down. Got my police report yesterday since I called the deputy when I got to dr office and he put the report in as priority so I could get the ball rolling for insurance. He didn't believe the kid was doing 25 like he claimed.

1. First mistake, is going back to work. If your doc has to medicate you, so you can walk, he had no business releasing you to work. [Especially, since he's not looked at the MRI!]

Damaged discs/vert do NOT heal up. Once bulged, cracked, or ruptured, they are there til they are repaired. The therapy and meds, such as epidural steroid injs, back supports, etc, only help minimize the pain.
3. Once you sue this moron, his ins company WILL be all over you, looking for the least bit of evidence that you are back to doing what you did B4 the wreck. [IE: following you, videoing your activities, sending "folks" to scope out your shop.]
The above comments come from someone that's been there done that, and have lived w/ the damage for over 25 yrs.[Got busted up in a headon w/ a drunk]

If you can't continue w/ your job, ask your atty if you could be awarded a % of disability, thru SS.
 
Eric, when my back starts acting up, I get the elastic back support on, PRONTO![Available at most hardware stores, Lowes, HD.$20.00] That's the only way I can "navigate", when the muscles start reacting.[I went to a sports med dr. he said "NO surgery, til you are brought in on a stretcher!]
My epidural injections worked VERY well. DO NOT expect a general med dr to know WTF to do...[His testimony may not be as well respected as a specialist, either]

Your pain is called "muscle guarding".
It is triggered by nerve inflamation.
The back hurts, the muscles attempt to "guard" the site, the tite muscle triggers more pain, and the cycle repeats, til you are in a knot.

Use care w/ all those OTC meds.. They can cause intestinal bleeding, if taken in big doses...

All of the above is really good plus you may want to delete this thread pretty soon just in case...... Those insurance company folks are pretty crafty about discovery and I wouldn't want any content here to come back on you. (see your name in your sig) Last thing I will say is to keep excellent documentation records on EVERYTHING! Date as well as time all your journal entries. Keep all of your medical receipts and request all of your medical records for your personal use. You have a right to anything and everything in your medical records per HIPAA policies and guidelines. Sorry that you are going through this this heavy duty situation!
