no 2-3 shift at WOT

at the track my tranny did not shift from 2-3 when I had the tranny in D.
Next run I put it in OD and it shifted fine, any idea what may be causing this?

Should not make any difference between D or OD

That's what I kinda suspected, I wonder if the fluid temp had something to do with it?
It's done it twice at the track, next day is fine on the road. May upgrade the pan to a large sump aluminum, and flush the fluid.
