I sold my 1980 turbo Regal sport coupe on ebay. The buyer paid me via paypal. I have not heard from him since 3 months ago. Not word one.
What do I do? How long do I have to wait to act and what action am I entitled to?

Is the buyer ignoring your correspondence?

I would tell him you're refunding his money via PayPal less eBay auction fees and a nominal 'storage fee' unless he picks up the car within 5 days.

The time limit is up regarding feedback on that auction if it's been 3 months.
 
IMO To hell with a refund.He paid for it so its his. If he hasnt even called or emailed id try to get in touch with him one last time then id add up the storage charge(going rate at a tow place is $35 a day) and tell him if he wants it he is going to have to pay the storage fee. NO REFUND.

You cannot charge him storage as he was never informed of a storage policy. You should get his contact info from ebay ( very easy to do) and call him to find out what happened. That would be the right thing to do. Maybe he is sick. I know you can relate to that.
 
Bruce owns a buisness and if someone leaves there car at his or any other mechanics shop,yes,legally they can charge a storage fee. Just because its not implied means NOTHING.

Try this Neal have your car towed,ill even pay for the towing,then go back 6 months later and try to get your car without paying a storage fee.Im sure that when they tow it they will say nothing about storage fees.

Ive NEVER,NEVER,NEVER,NEVER,NEVER,NEVER been told by ANY place that has towed my car that there is a storage fee but im smart enough to know there is. :)
 
Yes Bruce owns a business . But the business did not sell him the car Bruce did. A man would contact the buyer an find out what is wrong and should have not waited 3 months IMO. And towing has nothing to do about his question.
 
Oh one more thing. In my state and every state in know if your shop charges storage it must be posted for all to see with a policy. Like " afterwork has been completed vehicles left on premises will be charged a XX a day storage fee" .. that is the law here and many other places.

PS I own a shop too.
 
Your the one that said since no storage fee was implied that you cant charge for it.That is total bull ****.Doesnt matter if its an individual or a company you can LEGALLY charge a storage fee.

I agree that 3 months is an awfully long time to wait before asking ???s though.
 
And I suppose all wreckers have that statement on the side of there truck?????? And all auto tranport companys have it on the side of there vehicle as well??? No and no.
 
Different laws for different types of business. repair shops have a different set of rules and laws.

Actually the auction ended 2 months ago and it was for a 1979 Turbo Regal :rolleyes: I know, details, details. When you got so much going on it's hard to remember things like what cars you own and where you put torque convertors ;)

On a side note has IBADGN been picked up yet? :D

I have tried to contact

I am cool with it. I am moving and just do not know what to do with it. I told him I could leave it here for a week or so till he could get down here, but i do not want to charge him. i just want it gone. I have no more room. I do not want to screw anybody , I just want him to come get it.

20+ years of shop ownership and dealership managemnt is my experience with the laws pertaining to this matter.

Bruce, you have tried. just try once more and tell him after your gone his is SOl.

I understand what you are saying ,,but owning a businees doesnt mean that he can charge storage,,ie...I own a flower shop and sell you car on ebay ,,can I charge you a storage fee--no ...

Now I would just relist the car and sell it again:p :p :p :o

Tell the buyer you are going to leave the car with the keys and signed title on the front seat parked in front of your house.

That way he can pick it up when he is ready.
