Has anyone ever sued a New Car dealership over a TURBO car that they bought "AS IS"? The grounds are for a vehicle that has to have constant repair, one thing after another. From electrical to structural damage? I would love to see and hear everyone's opinion. Please advise!!

Running vs structual problems are two different things... Depends on your state laws as well... Here if you sign an "as is" statement up front that is the end of it running wise... Now if car was salvage at one point and they didn't disclose that up front you may have a case, depending on local law....
 
Let's say structural - rear control arm mounts are busted from frame...... Electrical - having to replace every connector on the engine harness costing hundreds (connections coming undone), Haven't looked under dash yet. Have spent over $400 in just coolant system repairs to verify that car didnt have head gasket problem, Plus the trans - torque convertor wont LU, either LU swith in trans is bad or ECM
 
Yep, that is going to be up to your local laws... Here you would probably have a chance, depending on how far you wanted to push it, because we have a law that if you buy a car to drive from a dealership it HAS TO BE STATE INSPECTED.... That would NOT pass inspection here... The other issues are just part of buying a used car....

I had to stop all warranties on my cars... Customer abuse... However I DO NOT do my own state inspections plus I ask the customer several times to take it to a mechanic of their choosing first so if something goes wrong they can yell at him not me:D

I would guess, unless they have a bad rep, they took it on trade and never did a damn thing but put it on the lot for sale... In their eyes it was a 25yr old buick:rolleyes:
 
I bought a modded WRX used from a dealership. I am a realistic guy, I know a car that has been modded can have issues, I can fix them. I drove the car from the dealership to a friends house to show him. We get in, pull out on to the road, I floor it, hit 2nd, goes up on the rev limiter. Blew out 2nd gear. Before I bought the car, I knew 2nd gear was a problem with those 5 speeds. The salesman was the cousin of the previous owner, he said, it has custom hand cut gears that won't break. The dealership had the car fixed, It cost them $3500, I had to pay $500. The gears in it were Subaru. Subaru had updated gears, so everything in the trans had to be changed. The car had no cat, and a check engine light on (which was from overboost when getting on a highway,etc.) I couldn't plate the car. By the time I got the car back from the trans shop, my temp tag was done. I knew I needed to put a cat on it, but I made them do it. After 2 months of owning the car and not driving it, I called the Ohio Attorney General. I was told, I never should have bought the car with the SES light on, and Ohio is a buyer beware state, and there is nothing they can do. I was trying to get a buy back for not being able to pass emissions. I told the General Manager to give me what I paid for it, and I would buy a new Dodge Ram, they already made the money on my Duramax trade in that was gone in 2 days, it would be like I traded it in on a new Dodge. He wouldn't do it.
 
WOW!! Sucky. I never seen the the busted frame until I got it on a lift this weekend. We will see...
 
Sounds like the car is a safety hazzard on the road. first I would take the car to a good mechanic and have it completely gone through and get a written report of findings. I would call the owner of the dealership and have a mature conversation about the liability involved. the car may be sold AS IS but in many states a car has to go through various inspections before it can be resold. I went through something similar.

There isn't much protection for anything bought as is for less than $5k here. The op says turbo car. Is this a turbo regal or something else? If it is it's probably had about 50 jack asses working on it 6 stupid owners and 3x as many things wrong with it than was noticed at first. Who is to blame for these short comings if it was sold as is? Buyer beware.
 
This is the precise reason why most new car dealers will send all their older used cars to the auction. Even if sold "as-is", nobody looks very close at the vehicle and figure the dealership is liable if it's screwed up. Dealer can't win. The previous owner will lie through their teeth to the dealer to get it traded but the dealer gets stuck with it if they don't catch it. And people wonder why dealers don't give any money for older trades. Costs a fortune just to be able to sell the damn car, they might as well auction it or scrap it. I'm about to load up a cosmetically NICE 2001 mitsu diamante with scrap iron because the mechanical issues exceed the value of the car. Looks like a $4k car but will take $4k to get it going. A dozen people have spoke for it and then backed out when they did their own math on it. Salvage yard isn't going to fight us, they buy it by the pound.....

When I buy cars "as-is", I understand that if it breaks in half in the parking lot, it's my problem.
 
Ya buy something "as-is" ya better well know what to look for, cause it is being sold that way for a reason!

the guys selling "AS-IS" are also telling you " there is nothing wrong with it, it could be driven from NY to Cali with NO issues"
don't forget about the guys that paint over rust to hide shitp.

Just the same as the individual who is selling a car from his driveway would tell you......

It's up to the buyer, especially if the car is 25+ years old, to investigate and find out what he's getting into.
 
These situations are very unfortunate. I have been selling cars for over 10 years. 7 years at a new car dealership and a little over 3 years out of my shop before that. It amazes me that someone can buy the biggest pos off the street and just chalk it up, but if it is from a dealership they think they are liable for every thing on a 20 year old car! These "as is" cars should be disclosed in a manner that is crystal clear to the buyer before he signs on the line. I have a form that has to be signed three times for the three ways it is explained so the customer is fully aware. It is sad because the dealer will never see this customer for another purchase, and the customer is bitter over the fact they have a junk. Even though the customer comes in to solicite the sale, somehow it is the dealers fault for selling the vehicle. I am fortunate to work at a dealership where every car has to be fully inspect, even if it is a wholesale vehicle going to the auction. There are laws to protect people, as stated each state is different. On the flipside imagine if we went after every customer who traded there car in and lied and hid problems!! The best one I hear is about why the check engine light is on, "it is only a 20.00 o2 sensor" other than that the car has nothing wrong with it! There are alot of bad dealers out there that paint a bad picture for all of us. With the internet now there is plenty of reviews of dealers to figure out if they are reputable or not.
 
as is where is, that is what the auction says at a lot of farm auction sales that i go too
there is allways few cars and pickup trucks along with big trucks, the auctioneer says all
sales are final, so you look at what you are going to bid on, i have been stuck a few
