Received damage goods thru the mail-not fixable or useable

UPS cover up to $100 @ n/c-I paid to sender $92

Is it my responsibilty to wait for sender to send claim in & wait for them to get paid before I get reimburse

I'd rather send product back(at my expense) to get full refund & they can have their 20 yr old part back,let them salvage the part & collect UPS insurance monies

I've received an item I purchased, which was shipped by UPS, and heavily damaged. You basically have to follow the UPS process to file a claim.

When you call the UPS customer service line to file a claim, they will tell you to keep the item in the original box it was shipped in. After a couple of days, an investigator will come pick up the damaged package and inspect it. They have to verify the item was damaged during shipping and not before or after it was shipped. There are lots of fraudulent claims going on with sellers shipping items that were damaged to begin with, so the buyer will have to file a claim to get their refund and the seller already got paid for a damaged item. Anyway, once the package is picked up by UPS, you have to wait for them to inspect and verify the item was damaged during shipping transit. Once they verify they (UPS) are responsible for the damage, they will mail the seller a check for the declared value amount. Yes, they mail the check to the seller, although you already paid the seller for the item. Then it is up to you to contact the seller and make sure they refund your money. I feel the process needs to be changed. All of this can take some time. It took me two months before I got my money back. This was about five years ago. Maybe the process has changed by now.

I would first try to determine if the seller adequately packaged the part. If not, your gripe is with the seller. Otherwise, you will have to wait on UPS. One would hope that the seller would refund your $'s immediately.

The key is to pack the part very well and to use a strong box. That should virtually eliminate trouble but some sellers just throw the part in any old box and let UPS work it's magic. You did get a photo of the part before it was shipped...right?

ps...the best policy is to deal with someone that you know and trust. Vendors like Cotton, GBody, McCoy, etc will make it right.
 
If it left them in good condition and you paid for insurance, I would think you would have to wait for UPS to refund. If it is a small vendor or individual ,they might not actually have the extra funds on hands as would a larger vendor. If at all possible,as a seller I would want to take care of my purchaser right away-but as I said, it might not be financially feasible.

You would think if someone has 20 yrd old car parts to sell-basically they have no money invested in them
But when you send them know good cash, then you should able to turn around send damaged product back for refund-especially if UPS would/if re-emburse the sender
Sender shouldn't be in in a finacial problem if they just received your PayPal payment

Here is the problem, if you just send them back UPS WILL NOT honor a claim and the vendor will lose the part and the money. UPS will send the driver out to inspect the part at the delivered location to check the packing and whatever. If you send it back what is to say it did not get damaged in the second shipment? It sucks but that is how it works.
 
I've been told more than once the shipper has to file the claim.
