2004R Filter Clip question

How would the trans perform with the filter clip installed like this:

My filter is installed with the clip holding the filter in place,I'm guessing that this is incorrect?

The spring is not supposed to hold the filter in place, as shown in that picture, but it is supposed to push the filter to the bottom of the pan.
