2004R puking fluid from vent tube

Need some input on why me GN trans has puked out fluid through vent tube,
WHEN COLD.
The level is maybe 1/8th down on the cross hatch of the dip tube.
Do not know what to add about the trans other than it is not stock.
Seem to run and shift good (pretty harsh)
Trans has lots of good hard parts, 5 disk lock up, PTS deep pan, ect.
If more info is needed I can ask the local Buick club member who has worked on it for several years.
I know about to full getting hot and expanding,but this is on less than 5 minutes idles in the garage.
Don't want to oil the track next week at our annual Buick/Ford shootout, here
in Okla City (Noble OK)

does it do it all the time? mine did it once right after i got it rebuilt and install a new torque converter. it hasnt done it since.

It has done this twice on the last two starts. I just happened to see these as the car wan idling in the drive way.
It was worse the second time.
My trans guy just called and he wants me to keep the fluid at the bottom of the cross hatch when cold. With this deep pan it will have room to expand.
I took this car in its condtion to the track two weeks ago and made some mid 11 passes, all seems well.
 
Could you possibly have the wrong dipstick? This should not happen. The fluid does not expand that much and the fact its cold tells me there is something else wrong that has nothing to do with the fluid level.

Dipstick good, same part number as my other 86GN.

Ive seen this happen on a couple of cars, one only when he does a burnout before a run and then nothing. I cant figure out why and Im thinking about moving the vent to the back of the case. I would like to know if anyone else has seen this too. It could be a pump issue. (crossleak)
 
I am having the same problem only under hard acceleration.

I spoke with Bruce at PTS today. He said to have a leak out of the vent tube
on a cold start, meant a cross leak in the pump, and or a internal leak when the trans is setting. ( I think this is what was said)
Mine has quit leaking for now. I will deal with it later
