I bought a gun from this guy on auction arms. I won the bidding (I bid $1.00 over the initial listed price).
These are the payment terms:

"Brand New S&W 637 Chiefs Special Airweight 38 Special+P 5-Shot 1 7/8" barrel 15oz.New in Box.Must ship to FFL ONLY! Make sure legal to own BEFORE bidding!This auction has been discounted 3% for CASH payments(money order/check) All credit cards are accepted.Lay-A-Way Available $100.00 down free for 45 days.Shipping to AK/HI will be higher."

(This is not the gun I bought)

Anyway, I told him I would send him a check for the amount I won the auction for plus the stated $26.00 s/h fee. I won the auction for $459.99 + $26.00=$485.99 less 3% cash discount =$471.41.

This is what I sent asking about the discount:

Dear sir,
I don't mean to be argumentative nor due I dispute the final price on this
revolver, but I fail to see where the 3% cash discount is applied. If I pay
by credit card the final price of the revolver should still be $485.99. I
don't understand where the 3% cash discount is applied? Your payment options
stated" This auction has been discounted 3% for CASH payments(money
order/check)". Again, I don't understand this statement. Please explain the
price before the discount is applied.

This is the reply I received from him:

The final price is $459.99 (Cash Payment)if you choose to pay with credit
card it will be 3% more.
If you read the auction it states "This auction HAS BEEN DISCOUNTED 3% FOR CASH PAYMENTS! That means $459.99 is the DISCOUNTED PRICE. It will not be discounted MORE.

He does not state if you pay by credit card the final price will be 3% more than your winning bid.
I think he was ambigious in his payment options. Do you agree or disagree.

Boy, thats kinda on the line.

I would assume the 3% off was already applied when the auction started and it states that its been applied for current price, for the first bid.

He doesnt say that the price will go up and additional 3% with paypal (which it infers) or lesser with cash sale...

It just states that the price has already been discounted 3% for this auction, and it doesnt matter if paid by cash or credit card.

I don't think he should mention a discount at all. What he should say is " A 3% surcharge will be added to payment by credit card" Currently he is infering a 3% discount applies to the winning bid if you pay by check or money order. We don't know if he applied a 3% discount as he claims.......
 
Yeah, but what he is saying is the 3% discount has been applied in THIS auction.
No matter what price you pay, the "discount" / (catcher of the deal) has already been applied before purchase....
Sorry, i just read it the way i see it.

yeah I'm gunna have to agree with Quick6'n-K.C. he does state that the 3% discount HAS been discounted in the auction. Although on an initial quick read I probably would have thought the same way you do, and I agree that it should just say that a 3% surcharge will be added for credit payments.

I don't see how anyone could apply a 3% discount to a price no one knows before the end of an auction. The seller was sloppy in his wording. Ebay doesn't allow(because they and Paypal are one company) a seller to state in their auction that there will be a surcharge for Paypal's blood money(or credit). I used to. Now I have the prospective buyers contact me prior to bidding if they intend to pay via Paypal(if it's a high ticket item I'm selling) to avoid any mis-understanding. By the way(addressing some of the replies): to "infer" means to conclude by reasoning, or deduce. You can't "infer" something secondary in a description or statement, but- you can "connote"(to suggest or imply).
