Any boaters here? The water 5.0 doesn't need any reason to stop you, they call it a "safety check". Got stopped Memorial Day weekend in front of Quantico M/B for this reason by the Marines. They were obviously training newbies. They asked to see the boats info and safety gear, looked around and then set me free, no problems. Glad I wasn't drinking. They have really stepped up BWI enforcement on the Potomac.

I'd like to see a show of hands of those who have been stopped (only your car and no others along with yours) by a police officer, then allowed to proceed with absolutely no other interaction. I am going to bet on none because police will look in and around your car while you are stopped and they will speak to you. They will look in the windows. They will look at you. They are looking for anything they can find. They will run your license and registration. That is a search. And it is about revenue generation as was mentioned. There is no argument that will convince me otherwise so save your bandwidth unless you just want to disagree and that is ok by me.

So... Turbotwin2 if this was your town you wouldn't mind having 48 drivers with no valid Lic. driving around you? Think about it 48 cars in a 6 hour period. Thats a good 8 cars an hour. I'm glad my local PD is doing this type of enforcement. The whole 4th amendment thing is for somone that has somthing to hide. I drive a blacked out GN with limo tint. If local Pd wanted to search It I would let them. All they would find is a very clean all original interior and maybe my girls panties...:biggrin:

So I was reading the local Escondido news paper and saw some interesting Stats. about a check point they had on the 5th of Dec. They ran the check point from 6PM to 12 Am. The end result was 44 cites and 48 cars impounded. 4 people were arrested for DUI. Esco. PD caught some flak about targeting mexicans by the ACLU and a group called "La Raza" in the past. So now Esco PD. announces where and when the check point will take place.

The good thing is 48 cars that don't need to be on the road were taken off. Esco. is a big hispanic community so i'm guessing my fellow peeps made up most of the cars being impounded. So for you guys out across america does your local PD do check points?

In CT they do them all year long. They are supposed to list the location of the check point and when prior to it and they are required to have a turn off point before the check point. Even with all that they still get a lot of cites. Im in SoCal myself right now and just drove from Santa Ana to HB down Warner Ave. I dont see how it would be possible to not have a high % of Mexican/hispanic pulled over. They make up a much larger % of the population than white in SoCal. Imo if your driving under the influence you should be cited. If your driving an unregistered car with no insurance you should be towed. CA has much steeper fines for unregistered cars than other states. There is no excuse for it. Illegals can legally get insurance and car reg in CA im told. If you want to drive then you should abide by the laws. That is some funny chit they gave the PD a hard time. Im sure the PD could be more more harsh and dig a lot deeper if they wanted. I wonder what % of those cited are illegal?

I do. Im a taxpaying US citizen and every other person that uses automobiles in this country for transportation on those roads should be paying the f'in taxes like i am. If they want to be treated like they belong here then they should conform and pay.

You would be suprised how many Unlicensed drivers do not know the basic rules of the road. Such as what a blinking red light indicates.

Unlicensed drivers are ignorant to some motor vehicle laws since they never had to show proficiency with a written and driving exam often misunderstand what a flashing red light indicates and often confuse it with requiring one to use "More" caution vs. stopping and treating it as a stop sign. They often think flashing yellow as caution and flashing red as more caution.

I have investigated (2) fatalities in the past for that exact reason from illegals who simply didn't not know what a flashing red light indicated. So it's a liitle more complicated then someone who just knows how to drive. If it was you family member dead as a result of their ignorance you might have a different opinion.

Unregistered drivers as well as Unlicensed drivers are also the ones taking off after they strike your vehicle in an accident. It's what makes up the majority of hit and run accidents. Not mention, I pay vehicle taxes and so do I you I would assume. If I gotta pay then so do they. Road maintenance is not FREE. It comes from tax dollars from those who pay to register their car, get a license and pay taxes on their vehicles.

You don't just get a free ride cause you know how to put the car in drive. So who cares you ask? You should for one.

Sorry brother but that is the dumbest comment i've heard on this board. I have nothing to hide but that doesn't give the anyone the right to enter my home and go through my personal belongings. Hell, why do we need the 2nd amendment? The goverment will protect us!

If a check point is being utilized for DUI then a specific pattern of cars must be adhered to in order for it to be legal. For example every other car, or every 3rd car, or every car if they choose. Usually not feasable on a busy highway but as long as a particular pattern (Random) is followed then stopping a car to make a visual (Red blood shot eyes), audio (Slurred speech), smell, (Smelling an alcoholic mixed beverage) does not infringe on anyones civil rights.:

Thats my little rant on the soberiety check points around here.

OHHH Thats not good. 4 DUI and 48 CARS impounded. What kind of people drive down the road all the time breaking the law?

Guess they will get caught one way or the other.

Law is the law, you break it time and agian, get caught and pay your dues.

We have all been there, speeding, wrecking, and other failures that we have encountered on the roadways.

Do i have any sympathy for 48 cars ripped out from these guys?

NOPE.

Last year there were over 100 impounded right in front of a school, i thought it was funny, who drops their kid off drinking beer in the morning / stolen tags / warrants / and high..

People are idiots, we only get to see the highlights.

Simple, to ensure that her PRIVILAGE to operate a vehicle has not been suspended for failure to pay an infraction, insure her car, or whatever else may have caused her privilage to operate a vehicle to be revoked or suspended. She may have a DUI warrant as well.

It takes about 10 seconds to run someones license on the computer. 10 seconds is not unreasonable amount of time to wait by anyones standards. Of course there is the time you are waiting in traffic to be checked but your waiting in traffic while construction takes place on the highway to make the road safer for you to operate on as well. Road improvements are conducted to make the roads safer to.

Those check points that may cause her to run a little late for work but are there to ensure that she actually does make it to work and back home to your family by removing drunks and criminals off the street who put her life in jeopardy.

Last check point i got stopped at took 3 minutes. They were not looking for little things either. If they were they would have given me a ticket for no front plate.

I highly doubt my comment is the dumbest on this board. I've read (not heard) a few dumb ones as well. Just MHO that if you don't have anything to hide don't be scared of a lil search. I'll hold your hand if needed;)

I guess we should go ahead and give up Due Process along with the 4th Amendment. Who wants to argue that this abomination is OK?

In Massachusettes you have to pay to get a court date for a traffic citation. I think that is giving up the due process of the law.
I don't mind most officers but many just don't understand what reasonable suspicion means or how important it is.
I know I would feel differently if someone close to me got hurt or killed by a person who shouldn't be on the road, but freedom which we arfe so lucky to have as Americans comes at a compromise to our safety in so many ways. I still think it is well worth it.
Implied consent is fine and all. That covers sobriety, paper work, and safety checks. It does not deal with search and seizure of private property. I don't care if it moves or is stationary, it is private property. I move Brett, would you like to do a cavity search, Punk?
