I sold an item to a person on ebay(he won the auction), and now
I'm having trouble getting the guy to pay me. It has been over
two weeks now and still no check or M/O. After the first week I
emailed him and he said he was sorry that he had forgot to
send the check and that he would send it right out. That was last
wednesday and still no payment. I emailed him today and told
him that I have his item sitting here ready to be shipped as soon
as I receive the check. This person has a excellent feedback rating
so I figured there would be no problem, but I'm starting to wonder. Since he was the highest bidder($500)and won the auction, is there any recourse that I can take if he doesn't pay up? I know that I can send negative feedback to his ebay rating,
but that won't help me get my money from him.

Not worth the trouble. I would report him to ebay and leave negative feedback. Send him one final email telling him what you are going to do and give him 48 hrs.
 
Ya, send him an email and give him 48hrs. He can overnight a letter with the mo in it to you.
 
Having the same problem with a guy who won an auction I had for a set of GN wheel centercaps. He asked during the auction if they would fit the aluminum T-Type wheels and I told him I didn't think so. He ended up winning the auction as he did not pull his bid and now I can't get a reply from him after 3 weeks. I am going to give him the 48 hr deal myself. At least mine was only for $41 not $500. Pretty much can chalk it up to another ebay lowlife.
 
maybe even use paypal.
i have only used it once and prefer not to but it may be an option.

to hold up his end of the deal or I will contact ebay with some
negative feedback.

It's X-mas time people. Mail is slow... people have a lot on their minds... things are a rush. Give him a little more time then do what you must. I had a Buick guy two weeks or more now that was suppose to send money for a crank. Nothing! I also e-mailed him. I am giving him until Monday of next week and if nothing I will move on to the next buyer. He is in NY so normal time would be 3 days in the mail. With it being the Holidays (always happens this time of year) I give him 10 just to be safe. Monday is the cut-off.
 
I agree with you intercooler, mail is slow this time of the year,
and normally I would allow 7-10 days to receive something
sent through the post office. BUT, this guy made it a point to tell
me that he was sending me a cashiers check by way of FEDEX on
11/26. After a week went by and no check from FEDEX, I figured
that something was wrong, so I emailed him and that is when he
said "I'm so sorry, I'm in the process of moving and I forgot to
send the check out" So I thought that is very possible, it could of
been a honest mistake. The guy then gives me his new address
and promises to send the check out the next day(12/4). I would
think that he would send it FEDEX or some other kind of express
delivery the second time around? If he had told me that the check
was coming by way of regular mail service, I would of waited two
weeks the first time before contacting him.

Mail may be slow this time of year but I don't think email slows down because of the holidays. My bozo has ignored about 6-7 emails from me.
 
I have down this before and its a great idea. Usually the person who got beat out wants it bad too. They are so happy that they have a second chance at the item. And don't forget to leave negative feedback for the deadbeat.

Some e-mail systems have a great feature that lets you know that the person you sent an e-mail to has read it. If yours has this feature send him one! If it shows up he read it and doesn't get back to you he gets what he deserves!
 
I've never sold anything through ebay, or bought anything for that matter, but I wouldn't care about the mail or the moving bit. If they want it, then they should make the proper arrangements to get the money to you, and to get in touch with you. After all, they said they were going to buy it, and you are waiting for money that you could have gotten from the next bidder. I'd tell them that it's over and give them negative feedback. I wouldn't trash them though, you don't need the headaches or retaliation that could come from it (just negative like 'did not pay', nothing like 'the scumbag loser dissed me for weeks, he must sleep with farm animals' kind). AND, they may have a legitimate excuse, but there is no reason that you should have to wait, since they are shirking their responsibilities. After all, they had the time to bid. They shouldn't have if they didn't have time to follow through. Just my opinion.

I forgot to mention that I think this guy has his own business,
he goes by the name of "atvconstruction"on ebay and all of his
feedback indicates that he buys and sells atv parts. Since I'm in
the Christmas spirit, I'll give him another 3-4 days before I send
negative feedback :) .

I've sold and bought many(well only 100 transactions and my wife another 50) and I run my auctions like I do my job(not self employed) and maybe I'm a little less forgiving than you but I always give them 30 days to pay. If your e-mails are not getting through,1 offer it to the 2nd bidder or,2 report them to e-bay as a non payer. You know this guy doesn't have the money so be up front with him and tell him to pay up or face the wrath of e-mails and banishment(exile?) from eBay. Maybe ask him honestly why he wont pay? I always like to come across as a good guy and freind instead of a azz!@#$. Whatever you do though do not lower your price! Maybe this is his game plan. BTW if he is a non payer eBay will refund your fees(assuming it isnt for a car,MC or ATV) but wont if you opt for the 2nd chance offer.

I personally SEND MONEY right away & follow up with email when I pay.
ASK MARK H. BuickGn Boosted how I am at paying! :)

But since I sell a lot of stuff on EB. I give 2 weeks. I am not going to chase someone for a $10 item.
But a big money item I would rather have the buyer level with me & say he can't buy it. Then as mentioned I move on to next bidder or relist it..

Some times relisting it you might sellit for more. this has happened to me & I am glad I sold the item for more :)


I sold PRONTO"S TA via EBAY & we cancelled the auction because the buyer saw it on Ebay cam up & offered to buy it in person. He PAID $500 more than BUY it now :):)
 
If this guy does finally send you a check I would sugest you make sure the check clears first before shipping him his package!
 
Thanks TurboD1987, that is good advice and I will definitely do
that if he sends a check, there is no way I'm going to trust this
guy any more.
