If you both appear with the same attorney (friend of the court) describing an amicable resolution, then immediate monetary equality isn't the same issue as is continuing equity in a property were you to be receiving a larger cash settlement in lieu of the property being divided or disbursed.
This is definitely a time to spend a few G's on legal representation.
I've just been thru this and in my case the attorney fee's outweighed the monetary gain in resolution of a disputed claim. But right was made as right as possible by Law, and the decedant's wishes were forcefully followed to the best of what could made by those who's greed did not overcome their respect.
Making a case for yourself tends to PO the legal system. Working with representation amicably will make everything smoother for your continued family unity in the future. Because it can get ugly Fast no matter your intent, and that's the last thing you want to be dealing with for the next couple years given your loss.
