Some of you may remember the story,
I was pulled over for "bald rear tires" (Mt drag radials) which were in fact within California regulations. The cop proceeded to give me a ticket for out of state registration and license.

I decided to just have the tires signed off. The lic. and reg. I fought.

What I did was file a Trial by Written Declaration. Here in CA you have a little known option to fight your ticket in writing without appearing in court. Its kind of tricky, but they want it to be tricky so people don't try and fight them.

In my case, I wrote that the code he wrote me up for simply said "no valid registration" and "no valid license" I made copies of both and showed that I had both. Neither statute stated anything about where that license or registration had to come from.
I waited until my court date and showed up with my paperwork. Instead of going to court I went to the big counter where they collect money and paperwork etc. Told them I wanted to file a trial by written declaration. They accepted the paperwork and then told me that it would be several weeks before I heard back since the police officer now had a few weeks to send in his arguments against me on paper. I also had to pay the full bail amount (the fine for the ticket: $342.00) with the hope that I would be getting it back when found not guilty.

Well I just got my letter from the county and I got a big fat DISMISSED!

I also got a check for the $342 dollars.

If you guys are in California and you ever get a ticket. Definitely file a Trial By Written Declaration. Even if you are found guilty, you can request a new trial in person! You can't lose. way to go! :smile: i got one this saturday night for speeding he said i was doing 113 in a 70mph zone ( alligator alley here in florida) but on the ticket he never writes how he clocked me at that speed. I think i'll fight it also.

Yep, I'm familiar with alligator alley... I'm originally from Miami myself ;)

Definitely fight it. I don't ever remember Florida having the option to do this.. look into it.

and Greg... you are absolutely right. I win most of my disputes (in life in general) stepping back, formulating my thoughts, and preparing tactful and factual arguments. Most people let their emotions get the better of them.

Congrats! I believe you should always fight a ticket.

I had a taste of success with winning a trial a few weeks ago; my wife and I were on the way to Turbo Thunder when the local state patrol guy pulled me over forr doing 71+ in a 60. Funny, as my wife was right behind me, and he acutally zoomed around her to pull me over!

Requested a trial date, and the officer never even bothered to show up!

Case dismissed.

LMFAO...... sorry boost but its soo true.. I often wonder if TB paid you to post, cause man you are in every post. Maybe it was good louck your ticket came to $$342... ya kno 3.42s dont cha??? heee hee heee..... Congrats on beating it. I fought a ticket once and I was totally wrong but I sweet talked th judge and she dismissed it. The cops jaw dropped and just eyed me. Needless to say I havent been in his PCT in months...

I believe its 6/10's of a mile he would have to follow u if he paced you with his speedo. Good luck with it either way
 
thanks nasty, :smile: , i have contacted a ticket attorney. hope everything is going good for you nasty, the state trooper was coming the oppisite way when he pulled me over.
