I was pulled over for "bald rear tires" (Mt drag radials) which were in fact within California regulations. The cop proceeded to give me a ticket for out of state registration and license.
I decided to just have the tires signed off. The lic. and reg. I fought.
What I did was file a Trial by Written Declaration. Here in CA you have a little known option to fight your ticket in writing without appearing in court. Its kind of tricky, but they want it to be tricky so people don't try and fight them.
In my case, I wrote that the code he wrote me up for simply said "no valid registration" and "no valid license" I made copies of both and showed that I had both. Neither statute stated anything about where that license or registration had to come from.
I waited until my court date and showed up with my paperwork. Instead of going to court I went to the big counter where they collect money and paperwork etc. Told them I wanted to file a trial by written declaration. They accepted the paperwork and then told me that it would be several weeks before I heard back since the police officer now had a few weeks to send in his arguments against me on paper. I also had to pay the full bail amount (the fine for the ticket: $342.00) with the hope that I would be getting it back when found not guilty.
Well I just got my letter from the county and I got a big fat DISMISSED!
I also got a check for the $342 dollars.
If you guys are in California and you ever get a ticket. Definitely file a Trial By Written Declaration. Even if you are found guilty, you can request a new trial in person! You can't lose.
