I can't delete or modify my original post so I'll just say this. Your post has an anti-law enforcement tone to it. Most people are very supportive of LEO's, and there are those few who are not. Just a fact of life. Keep in mind that when you express opinions of this nature you are going to have those who are opposed to your opinion and that can, and will, effect their perception of you. As a business man, that is going to have have a direct effect on your business. As a cop, I do not patronize anti-law types. There are some around my area and they have given their opinion of me to me, and I do not give them my money. Just a suggestion, man.

Sean Let me just give you a small but brief summery of me just so you understand 100% where i'm coming from.

1) My post in NO WAY had a Anti-Law inforcement tone to it!! Realistically there was not tone!! ahhhh the internet tones again!! :smile:

2) I am NOT the Anti-Law type!!

3) I support my local law enforcement !!

4) I support my local firefighters

5) I'm good freinds with ALOT of cops!

6) I'm good freinds with ALOT of Private Investigators!

Would that be 5min prior to being pulled over?
Would that be 5hrs prior to being pulled over?

Does it matter when the marijuana was in the car? If you are stupid enough to smoke it in your car or have it on you in the car and are fortunate enough to be pulled over in that same car, sit back and watch it being searched. :D As far as the windows being rolled up and the eye roll............not sure what your getting at. Why do you think smokers ride around in the winter with their windows down..........her's a hint, it doesn't help.
 
The smell of ATF(thats Auto Tranny Fluid and not Alky,Tobacky & Flamethrowers to you LEOs) soaked into good ol' American cardboard also smells like reefer. So I guess you Jersey guys better not be hauling around your old torque convertors in your car if you don't want some bonehead abusing your 4th Admendment rights.:mad:

This sounds like a fascist movement that would be coming to Nevada since we are so liberal (and also our proximity with California has proven us to make many copycat liberal laws like they have:mad: ). We just have idiot lawmakers trying to make the Electronic Control Device aka Taser a deadly force option when it is not lethal force but only has killed people to my knowledge who are in custody who are in A) Bad health, obese, unfit conditions. B) Under influence of substance aka Cocaine, Speed, certain prescription druges, etc. C) Under influence of alcohol. When will it be easier to do my job? Probably never:cool:
 
Bad cops

Lets say there are a few bad cops, and we all know there are a lot.What happens between the time your car is being towed and the time it get to the police station? Could a cop plant some dope in your car so they could confiscate it? What happens to your Turbo Buick? I would rather have him search your car when he pulls you over.What happens when they don't find any dope? You still have to pay the towing bill?

I have been all over the country and never been searched. I guess they had no reason too. I think alot of times it comes down to your attitude with the officer. Most I have come across are very respectful and just ask for the same in return. That is not too much to ask IMO...

Closest I have ever been was at BPG a few years ago. I had a Red Bull and the guy with me had a few beers at the restaurant. We hit a massive check point and the guy smelled alcohol. He must have signaled or something, next thing I know my truck is swarmed by cops and flashlights lit up the inside of the truck. He asked if I had been drinking, I POLITLEY responded "no sir." I asked was something wrong, I felt like we were getting ready to be pulled out and handcuffed:eek: He said "I smell alcohol," and I said hold on, I have been drinking Red Bull and showed him the can and I told him my passenger had been drinking at the restaurant. They scanned the truck with the lights good. I started to open the door and said "Sir if you want me to take a test I will, again very politely." He said it wouldn't be necessary and we went on our way...

Point is I was cool, didn't have nothing to hide and was nice... I could easily see that situation turning ugly real quick... First off a white man and a black man from out of state on a Dealer Plate. Truck loaded down with stuff from Laptops to DVD Cameras, some race stuff etc... They smelled alcohol in the truck, like I said my buddy had a few... I feel sure if I would have popped off at the mouth about all the lights and commotion and got all "my rights" things would have turned out differently... I would have at least been made to blow, which was fine I was not drinking, and they could have tore the truck apart...

Attitude can change any situation...

If you come across a cop that wants to frame you he/she will do it whether it’s in your face or in a tow yard plain and simple.

If you come across a cop that wants to search your car he will and there’s nothing you could do or say about it.

The old way - They would simply fock your car up right in front of you (like a bunch of specific POS did to me). Now a days this is better because everybody and their grandma has a cam and could be taping it and maybe you can use it later to file a claim in court which is useless because they are not accountable but at least it goes in as formal complaint and it becomes a public record that the next guy can use.

The new way they take you car behind close doors (which is worst) fock your car up. And you have no proof or witness of their actions which still doesn't matter since they are not accountable for their actions.

I guess the one thing that could be good is after a few times of empty fishing baskets the judge starts blowing them off and starts asking for "something" with the smell.

They can still use the "I saw him reaching under the seat" BS and still turn your car upside down so this is all BS no matter which way you look at it. Instead of I smelled the garbage. I saw him reaching under the seat. What’s the deference?

The random BS searches some times turn up a jack pot. This is good for all of us and the reason i think they do it.
But when they don’t turn anything up the person which was just violated gets no compensation for their time or property. They are so faceless that they won't even apologize for their fock up. This is where I have a problem.

I would like to have a dollar for everytime I took a breathalizer for a cop who smelled booze on me. I don't even drink ever!!!!

The family of (4) that was just T-Boned at an intersection while someone was High on weed causing their (6) yr. old daughter to become a paraplegic and eat thru a straw for the next 80 years. That's who cares....

Or they were hit by a lady putting on make-up or a person texting or even just useing the phone,maybe that 90 year old that is taking meds legally and still attempting to drive they might want to worry about?

I smoked my share of weed when I was younger and im 100% sure I was a way safer driver than any of the ones I listed above,as I was paronoid and actually drove the speed limit or slower...
 
Unfortunately tommy, not all people react to weed like you did. Some do have adverse reactions that would make them a less safe driver. I do agree that some can drive perfectly well high. But let's not cloud the debate with that issue. The botom line is that if a cop pulls over a driver that is smoking or has recently smoked, that person will still face the penalty of the law. Hopefully this will prevent abuse from officers that want to go on a fishing expedition to find something. It protects the innocent, which I'm amazed that people here have a problem with that. Why not allow warrentless searches of our homes? After all, if you're not doing anything wrong, you have nothing to fear.... right? :rolleyes:
 
So does this mean a unethical cop will only pull over someone just before his shift ends to collect the OT?
Does the driver get a choice of a flatbed?
Is the driver reimbursed if nothing is found?
what about if a flight or important appointment is missed?
Does it open the City to litigation/suit?

It says that they have to wait for a warrant before searching the car. To me it seems that you can just say, "Sure go ahead and search the car." and you won't have to go into town and watch your car get towed. If you aren't hiding anything and they don't come across anything then they probably won't tear your car apart. I think the towing and warrant thing is probably just if someone refuses to allow the search. That way if something is found and it goes to court, it can't be thrown out saying that it was an unlawful search. (I watch cop shows. :smile: )
 
The smell of burnt marijuana or fresh marijuana is very distinct and anyone in law enforcement can identify with proper training:

If a Rookie needs "proper training" to know what weed smells like he must have grown up on the Moon or was a locker hugger.

I think the towing part is extreme, I got pulled over in GA late one night and the troopers wanted to tear into my car "I Dont Smoke POT!" I told them to bring in the K9 Because Id welcome a dog into my car before Id welcome them..only due to their attitudes, givin me sh1t at 3am on I-75 trying to put miles behind me at 62.5 mph

Theres prolly 20 cops in this forum and I doubt any one of them including Billy or Buckeyetrooper needed any training.

Most law enforcement agencies if not all these days require officers who are in training at the academy to smell both burnt marijuana and fresh marijuana. The reason is so that they can testify in court that they knew the smell that they detected. You are probably correct that most people have smelled it at other times in their lives but this is mainly for court purposes. And by the way, you know nothing about me. ;)
