New York statewide smoking ban signed into law

ALBANY, New York (AP) -- A statewide smoking ban was passed Wednesday by the Legislature and immediately signed by Gov. George Pataki, making New York the third state to stamp out cigarettes in virtually all businesses.

Scheduled to take effect in July, the measure largely mirrors a smoking ban starting Sunday in New York City.

The legislation ends smoking in most places where it is still allowed: bars, certain restaurants, betting parlors, bowling alleys, pool halls and even company cars. It calls for fines up to $1,000 per violation.

Exemptions include private residences, personal cars, Indian casinos and "cigar bars" already registered in New York City.

Sponsors said the measure puts New York alongside California and Delaware as having the most stringent indoor smoking prohibitions in the nation and will improve the health of tens of thousands of employees.

"We passed New York state's strongest public health policy ever," said the bill's chief sponsor in the Senate, Republican Charles Fuschillo.

The measure was approved by the GOP-controlled Senate 57-4 and the Democrat-dominated Assembly 96-44.

Lise DeWald Stoll, Pataki's spokeswoman, said the governor signed the measure despite having "reservations." She declined to elaborate.

The bill had its critics.

Sen. John Sabini, a Democrat who represents New York City's borough of Queens, said the state was doing a disservice to bar and restaurant owners who've built rooms with ventilation systems to comply with an exemption to the city's ban. The state law carries no such exemption.
 
This is absurd! I don't even smoke and I am so mad I'm about to blow a gasket. I can understand how Democratic liberals can vote for this bill, but how in the world can Republicans support it? These guys are supposed to be against big government? Only 4 voted against it in the NYS Senate! And our worthless governor, George Pataki, signed it into law. I hate this guy so much! :mad: He has the nerve to call himself a Republican? Here in NY, sadly, the Republicans are worthless, like Bloomberg, Pataki, etc. I hope the Supreme Court overturns this law, as it's our only hope for survival against Big Brother. A right-wing revolution is the only thing that will change this country...

I wonder how Hillary voted??? Connecticut will be the next state to be regulated to death. To many damn liberals here also!!:mad: And by the way........I don't smoke either.:eek:
 
I am also a non-smoker, but respect the rights of otherxs to do so. You wait and see, the feds will eventually go after the big tobacco companies. It's a political correctness thing.

That would be like not allowing McDonald's to sell hamburgers because they are high in fat. And who knows, that may be next.
 
cigarettes suck. i feel bad for smokers, but at the same time i really dislike the smell of butts so i dont feel that bad. sorry

Since it was a statewide and not a federal ban, Hillary had no say (she's a US Senator, not a State Senator). But if she did, I'm sure she would have supported it, knowing her. They're always trying to ban something. If it's not smoking, it's driving with cell phones (which it's proven that everyone still does).

Sorry, but it doesn't work that way. If you don't want to smell smoke, go to a restaurant or club that bans it. If you don't want smoking in YOUR car, then don't allow it. If you don't wanna smell it in a bar, well, too bad. Drinking is worse than smoking anyway. I personally dislike cigarettes too, but I really miss the good old days (prolly like 10-15 years ago) when smoking was allowed in the mall. America was so beautiful when it was still free, before the socialists took over the country...
 
I think it's great. Smoke sucks when you are trying to enjoy a meal or outdoor event. I also don't think it's a Rep or Dem issue. Just common respect for others that most people these days don't have. So stupid laws like this will be needed. "Yeild right of way" signs are only 25 years old. I guess thats why they made the signs and fine you if you don't. :rolleyes:

I don't really like smoke while I'm eating either, but nowhere in the US do you have to be forced to eat in front of smoke. Go to a restaurant where there's a smoking section, or one that bans smoking completely. It is a Rep and Dem issue. Pataki is a bum who is anti-smoking, pro-abortion, pro-gun-control, pro-gay, pro-cell phone ban while driving, and he even vetoed a bill to allow Staten Island drivers to turn right on red. He should be kicked out of the party. :mad:

The problem with cigarettes is that they don't kill quickly enough. If smokers died in months rather than years, I wonder how many people would smoke?

Of course, smokers expect to receive medical treatment to the tune of billions of dollars when they finally sucumb to cancer, heart disease, etc., don't they - no matter that we all pay for it?

Here's an idea. Load up 1 in every 100,000 cigarettes with an explosive device. Like, you light up and your head blows off. Driving in your car. In a mall. At a restaurant. That'd make smokers quit, never knowing when they'd get a loaded one...

Second hand smoke is over-rated. While not a total myth like the Greenhouse Effect, it is endorsed by big government liberals nonetheless. How many times do I have to repeat myself, you don't have to smell smoke in a restaurant (go in the no-smoking section) or car (don't allow smoking in YOUR car) if you don't want to. Jeeze, you anti-smoking guys are almost as bad as the war protestors. :)
 
I quit smoking almost 2 years ago, after smoking for about 10 years. My wife quit last Fall after smoking a lot longer than that. I'm glad you don't die immediately--you need a chance to learn from your mistakes. Being a smoker doesn't make you "evil" or a bad person. Most smokers are respectful of other people, there's just a minority that are militant about smoking anywhere in public. You get people like that in any group. There are lots of bad habits out there that can impact others, smoking is just the recent fad for picking on people. It's "cool" to be excessively hateful to smokers. For us, it's still not easy when around smoke, but we're done with it. I think it should be up to the restaurant owner/bar owner as to what kind of place he/she wants to run. It's *their* business, to succeed or fail. It opens up niche markets that way, all can benefit. What gets me is that cigars are rarely considered when smoking comes up. Like was said, cigar bars already existing are okay. Why not allow the bars that currently allow smoking to keep operating as such? Allow the one that is *centered* on smoking to exist, but not the other? Cigars have an elitist stigma, and are generally accepted a lot more than cigarettes. Why? Because you don't inhale as much? Still addictive (nicotine), stronger than cigarettes and even if you don't inhale much you're still getting your own 2nd hand smoke. I'm not against cigars, but I'm saying that they stamp out one but allow the other which is hypocritical. Wonder which many rich politicians and famous people smoke? I guess if you pay $30 for a nice Punch, smoking is okay, but if you pay $5 for a pack of smokes you're evil. Allow smoking in bars/restaurants where the owner wants it, just like the cigar bars that probably have a liquor license (cigars and brandy just go together ;) ), and let people decide where they want to go. We try to stay away from smoke, but that's MY choice and I don't see why I should inflict my opinion on someone else.

I think we all know that the best bars, the one's that will make the money, will be the ones that allow smoking. The majority of bar patrons smoke. The owners who don't want smoking in their bars are just trying to bring the others down with them.


Lot's of reall heavy topics here lately, not just the war. I think we need a "Fluff" post Friday. ;) Lighten the mood some, too much thinking. :D
 
OK, for the narrow minded....I'll put out there in plain, simple english:

This is the point. It isn't pro or con smoking, It's about the government PROTECTING US FROM OUR SELVES.

How long until things like
sugar
alcohol
race gas etc...

Are banned because of their danger?
I HATE guns....but I do not want them banned.

If it STARTS, it will be hard to stop. Anti smokers will be all for this type of ban UNTIL it effects them...then they will wonder "why". It all started somewhere....

Coffee is hot and can burn your crotch if you spill it....no more coffee....oh wait....you could sue and make millions over this one.

It's still America! If someone wants to smoke, then fine. It's not illegal....at least not YET!

My sincere congratulations to you and your wife for quitting!!!

So far as cigar smokers go, they're the worst, most arrogant offenders. Which is why I pick fights with them at football games.

I DO NOT buy the argument that non-smokers don't have to patronize establishments that allow smoking. For example, we have a favorite restaurant that (regretfully) allows smoking. Should we stop going because a few pukes insist on smoking? I say let the few pukes go home and set themselves on fire in their beds, like they seem to like to do.

I also don't buy the argument that said restaurant will lose business should smoking be outlawed because one, smokers will not stop going to said restaurant just because they can't light up and 2, if they did stop going, non-smokers will simply fill in behind them - there are 4 non-smokers for every smoker.

Bottom line - pick a habit that doesn't kill other people. Then, do whatever the hell you want...

This is sort of amusing ;) You'll hear the smokers and even some non smokers screaming for months.

Well New Yorkers, welcome to what CA has had in effect now for YEARS!!!! (Yes I used to live there).

The bar owners screamed bloody murder! "How are we supposed to make a living if smoking is banned in all public places?" They were sure that they would loose so much business that they'd be bankrupt in weeks.

Well, the world of reality has set in out there, and the restaurant and bar owners have discovered that NOT ONLY DID THEY NOT LOOSE BUSINESS, BUSINESS ACTUALLY PICKED UP. You see, now they have the extra business of all the NON smokers that actually wanted to enjoy these places but couldn't, because of the stinking smell they walked out with all the time.

I know it's hard to believe, but take a lesson from a state that has had a public ban on smoking active for several years now. No the world really doesn't come to an end. It's not the apocolipse! Life goes on. The bar and restaurant business will in a very short period of time actually increase!!

Our state legislature just recently tried to pass a very similar bill here, but it did not make it through. Thank God. One thing I noticed though which was very intriguing, party affilliation almost seemed irrelevant on this issue. There were hard line left wingers for it, and hard line left wingers against it. Same with the conservatives. I can't recall the last time I saw an issue that was not pretty evenly split among parties in terms of support, or lack of support. This seems to be an issue that transends party lines, and touches people personally.
 
I think I'll write my congressman and ask for the window tint legal limit to be rewritten to abolish any sort of tint. After all, the driver might be fine with it, but it is more vision imparing than clear glass. Therefore, there is a chance that the driver might not see me and I could be hurt from the resulting accident should we collide. Sorry but I have to protect my life and if the legal system is the way to get it accomplished, then you'll just have to conform to my selfish needs should I be successful. Government would rake in millions in fines each year.

Next, I'll be pushing for a GPS system to be installed on all vehicles so that at any moment the speedlimit on your road of choice is exceeded by you, you will receive a ticket in the mail. Sorry but my life could be endangered when you speed. No argument; your speed is documented. Government would rake in billions in fines each year. How much farther left do you really want to go? All this and more is possible.....and yes, I'm wasting bandwidth. :D
