The problem is:
Scumbags are too stupid to "learn" from other scum, that robbing/murder/rape, etc, will get you killed.
There IS NO cure for stupid.
IMO, just being in MY country, illegally, is good cause for being shot...

In hindsight... they would've faired MUCH better doing that, than they did by welcoming them.

The man should be given a award for doing what everyone in this USA should be capable of doing. Those thugs got what was coming to them and glad they are dead, they deserved every bit of it.

I actually yelled at my computer monitor when the deceased wife with her comment about that Joe Horn "wanted to shoot them anyway" YEAH BITCH, THEY WERE BREAKING THE ****ING LAW!!!

If anyone has any info of a Joe Horn fund my money is going to support him!

Hahah, Europeans and Spaniards huh? Look at a map lately? Spain is part of Europe. Borders France, a little south of England.

When they came there was not much to invade since they were worshiped as Gods by some, and the others had no concept of land ownership thus there was no land to "take" from them. Thats besides the point, those indians (they weren't killed off either their descendents are crossing our border every day) were not the first here, there is substantial archeological evidence that European peoples arrived first and were either killed or died off in the subsequent invasion from east Asia. Look up clovis tool culture.

Anyway there are militarized borders around the world and when someone gets shot for crossing one there is no international outcry. We have troops shooting border crossers in Iraq and a welcoming party for them here. Seems kind of odd to me.
 
Protection

Yes absolutely if at anytime your life or family's life/wellbeing is threatened /imminate danger by burgular/ assailant you are allowed to use deadly force to incompacitate, but once the threat is not imminate you cannot use deadly force. The burgular turned assaillant better not have bullets in his back as any court will look at that as the burgular/criminal as having turned and fleeing so imminate danger is not present so shooting him is not justified.

Guy here had his garage and car burgularized the guy attacked him so he tried to apprehend the thief had another scufffle guy got loose so he continued to chase him down the block and shot him in the back. The thief died and the homeowner went to prison ruled unjustified because the thief wasn't a threat to him anymore he was running away. Now had he shot him in the garage when the thief 1st attacked him and was a threat he wouldn't be doing time.

Police officer working at a local Sporting Good stoore once told me if your life and family's life is threatened by an Intruder/burgular besure and use deadly force don't mess around, if you use your shotgun for home defense and lets say your compassionate and decide to shoot him in the legs and he's incapacitated by shooting his legs out from under him so he can't reach you to be a Lethal threar anymore. His Lawyer will sue you and you will be paying for his Physical Rehabilitation so kill him where he stands. Went home with a H&K M1 Super 90 with a pistol grip,ghost ring sites and a shorter barrel for better home protection tactics /manueverbility the Police officer was a good salesman.

Don't shoot em in the back it won't look good for you.
 
Like I said on my other board... Is a few objects worth two human lives? No, not really. ESPECIALLY if its not yours. Though, do I feel bad for those two losers? NOPE. You took the gamble, and lost. Sorry 'bout your luck buddy. That guy undoubtedly prevented more crime from those two, and sent a message to the rest of the would be thugs, that if you come up in this neighborhood, you better watch out. And I think its a good sign too.
Now if those neighbors were really close friends, then I can imagine the situation would have been a touch different. If I seen someone trying to steal, for ex. a neighbors turbo regal? Yea, Id shoot em dead too. If I caught those two on MY property, or in my house, it's tomahawk time. (im not a fan of using bullets within a dense, built up area, in these lawsuit happy times) I'd chase those guys down too. And I know they dont run as much as I do.
But I just read, that it is indeed legal, to utilize deadly force to protect third party property... I wish we had that here.
 
Definitions of & statutes regarding lethal force & justifyable homicide vary or are controled state to state, so what workd in Florida does not work in Kali. I believe that some states allow for lethal force while protecting property only and without life being threatened and / or in danger. Do not try this in Kali though. Kali does not seem to be very sympathetic towards non-criminal individual rights, only the criminals.
 
I think they will hang the shooter.

I dont think the shooter will escape indictment if there is no evidence that one or both of the offenders were fleeing with proceeds of the burglary. I love the law in fact I wish they had that wording in Illinois law, but I believe there will be no proceeds located on or around the offenders because if there was that would have been explained in the article and there would be no talk of an indictment. Im sure the shooter is a good guy but I believe he may not have had a full grasp of the statute. Theres no doubt that he did the community a great service, and the fact that the offenders fit the description of the sketch means sqwat. That information has nothing to do with the shooting. This incident has to be examined as a single incident. If they let him slide it will be only because there is no family of the offenders waiting to file a multi million dollar complaint for wrongful death. Im wondering also how the Texas law is interpreted, it appears to me that Texas is real big on protecting property so Im guessing that (for example) if the Offenders made it outside with the proceeds (T.V.) then dropped the T.V. and continued to flee then the law does not allow the neighbor or home owner to shoot. Im gonna do alil research on Texas law. If anyone can post the statute please do.
 
From the Texas Penal Code concerning the use of deadly force to protect property:

§ 9.42. DEADLY FORCE TO PROTECT PROPERTY. A person is justified in using deadly force against another to protect land or tangible, movable property:
(1) if he would be justified in using force against the other under Section 9.41; and
(2) when and to the degree he reasonably believes the deadly force is immediately necessary:

(A) to prevent the other's imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime; or
(B) to prevent the other who is fleeing immediately after committing burglary, robbery, aggravated robbery, or theft during the nighttime from escaping with the property; and

(3) he reasonably believes that:
(A) the land or property cannot be protected or recovered by any other means; or
(B) the use of force other than deadly force to protect or recover the land or property would expose the actor or another to a substantial risk of death or serious bodily injury.

§ 9.43. PROTECTION OF THIRD PERSON'S PROPERTY. A person is justified in using force or deadly force against another to protect land or tangible, movable property of a third person if, under the circumstances as he reasonably believes them to be, the actor would be justified under Section 9.41 or 9.42 in using force or deadly force to protect his own land or property and:

(1) the actor reasonably believes the unlawful interference constitutes attempted or consummated theft of or criminal mischief to the tangible, movable property

While I was away I found the 911 conversation. Operator: "I've got officers coming out there. I don't want you to go outside that house and I don't want you to have that gun in your hand when those officers are poking around out there."

Caller: "I understand that, but I have a right to protect myself too, sir."

Caller: "Here it goes, buddy." (sound of shotgun pumping) "You hear the shotgun clicking and I'm going."

Operator: "Don't go outside." (sound of shotgun pumping)

The man became upset as he described seeing two men leaving his neighbor's home.

Caller: "They got a bag of something."

Operator: "Don't go outside the house."

Caller: "I'm doing it."

Operator: "Do not go outside the house."

Caller: "I'm sorry. This ain't right, buddy."

Operator: You're going to get yourself shot if you go outside that house with the gun."

Caller: "You wanna make a bet? I'm going to kill them."

Moments later a shotgun was heard firing at least twice.

Both suspects died at the scene. Their names have not been released.

Police found a pillowcase stuffed with hundreds of dollars.

In the aftermath, the 911 operator tried to get a handle on the situation.

Operator: "Put that gun down before you shoot an officer of mine. I've got several officers out there without uniforms on."

Caller: "I'm in the front yard right now."

Operator: "Put that gun down!"

The problem I think is that he was told by the operator that plain clothes officers were responding which means that there is a likely hood that the Offenders will be caught. At that point his justification is not as strong under the statute. This is going to be interesting.
 
Man Im really starting to like Texas more and more.

The laws read like a Chicago Mob Boss wrote them. "Yeah I can kill a burglar if I think my neighbor would want me to!---U gotta problem with that?" ;) God bless Texas, my new favorite State

I think this guy is going most likely going to be charged for killing those 2 men. He didn't have to go after them, and had it set in his mind he was going to kill them. He better get a good Lawyer in my opinion.

I'm personally not defending him, or accusing him. But I think society is getting tired of all the home invasions, burglaries, senseless crime in general - People are just fed up with a weak Justice System, Period. I think it's good if criminals start to think twice about robbing homes if they can possibly be shot and killed....
 
If one is running out the door then no. If one is running at me then yes. Or I would unleash this on him.....

I'm sorry, as I know that this thing took 2 lives, criminals or not, but the verbage between the 911 dispatcher & the caller is nothing short of hilarious. Good thing that the 3 b's (bubbas behind bars) don't like old tail. Guy might survive jail and / or prison for a while. I would not want to be in his shoes, especially after that verbage exchange.
 
The case is onto the DA.

The "Fiancee" of one of the burglars was crying on TV.
She stated that she could not sleep at night thinking about her fiancee now being dead.

Just think of the people who were victemized if they can now sleep in their home and bed. Cry me a river .......... :mad:

Criminals have more rights than honest people who pay the salaries of the politicians! What a joke we have become!

Yeah I hear yah, boo hoo, tell him not to be a THIEF in the next life lol. In my home treating me or my family your a dead man. It all depends really to me, if I walked outside and caught 2 teenagers trying to steal a rim off my car would I kill them? No, they are being kids and dumb, would I hold them till the law got there with a few bruises on them lol you bettca. I couldn't see killing 2 young people over something that petty but they would learn a lesson over it. It really all depends on the situation to me. The only thing worse to me than a liar is a thief but you still have to use your head on it.
